Prosecutors ask court to reject Dotson attempt for new trial CHICAGO (AP) Prosecutors went to court today to oppose a new trial for Gary Dotson, who is seeking to prove himself innocent of raping a woman who now says the rape never occurred. At a 'hearing in Cook County Circuit Court, Assistant State's Attorney Scott Arthur filed a motion to dismiss Dotson's petition for a new trial. Chief Criminal Judge Richard Fitzgerald gave Arthur until May 30 to file supporting documents, and scheduled a hearing June 4. Dotson, already free from prison after his sentence was commuted by the governor, will clear his name if Fitzgerald grants his request for a new trial, Dotson's lawyer said. "Up until now, we've been under the burden of proving that Gary is innocent," attorney Warren Lupel said Monday.

"If we gain a new trial, the state will be compelled to prove he's guilty and that's a clear impossibility." Today's brief hearing came two days after Gov. James R. Thompson commuted Dotson's 25- to 50- year prison sentence to time served, six years, but denied Dot-. son the pardon he sought. As a convicted felon, Dotson cannot vote or hold public office.

Roger Christian, a bicyclist from Canton, said witnesses told him the car that hit Craig Street, 22, of Monticello, was driven by a young man who had a girl with him. "He looked like he intentionally just tried to run this fellow down," said Christian. Street, a student at Ball State University in Muncie, was participating in the 24th annual tour that drew more than 4,400 cyclists for a 210-mile round trip from Columbus to Portsmouth, along the Ohio River.

Street was listed in poor condition in Grant Hospital's intensive care unit Monday with a fractured skull, his right leg broken in.at least five places and numerous cuts. Street's mother, Helen, said she expected her son to undergo additional surgery later this week. Meanwhile, Pickaway County sheriff's deputies said they were. searching Monday for an automobile believed involved in the crash. Witnesses provided deputies with the car's license number.

However, the owner told the Columbus Citizen-Journal that his car apparently was stolen from in front of his Columbus home either Saturday night or Sunday. Sheriff's Sgt. James Fite said Street was riding north on Ohio 104 just south of the Franklin County line about 4 p.m. Sunday when a southbound car swerved across the center line and ran into Street.
